Iowa Class Actions

Des Moines Class Action Lawyer

Advocating for fairness for all

Our firm regularly handles class actions lawsuits covering various types of wrongdoing. A class action is a type of claim that allows one or more people (the "named plaintiff"or "class representative") to bring suit on behalf of an entire group of people (the "class" or "class members"). Everyone who's part of the class is entitled to take part in any legal remedies derived from the class action, even though they may have to do only a minor amount or no work at all to benefit. The class members often simply ride the coattails of the named plaintiffs or class representatives.

Class actions involve individual claims that are too small to be brought on their own. Class action law allows many small claims to be combined into one large claim led by the named plaintiff or class representative. A class action's purpose is to allow many victims to assert legal rights that otherwise might be too small, time-consuming, and expensive to assert on their own. Another purpose is to avoid flooding the courts with many smaller suits asserting the same basic rights.

Class actions require an extra level of legal expertise beyond that normally necessary. Attorneys pursuing class actions must not only know the law regarding and be able to prove the basic claim that underlies the class action, but must also be familiar with and skilled at the procedural intricacies that must be navigated to successfully prosecute a class action lawsuit from beginning to end. There's an entirely separate body of caselaw, rules, and procedures that only apply to class actions, which can create many pitfalls for a class action. Those procedural pitfalls can cause the end of a class action even if the underlying legal claim is solid, leaving all the class members to pursue their small legal claims individually.

We have worked on class actions that have covered a diverse array of wrongdoing:

  • Defective products, particularly vehicles that have safety issues or are subject to safety recalls.

  • Consumer fraud.

  • Construction law.

  • Constitutional claims.

  • Wage and hour law.
